Begun and held in Metro Manila, on Monday, the twenty-third day of July, two thousand eighteen.

REPUBLIC ACT No. 11261

An Act Waiving Government Fees and Charges in the Issuance of Documents Required in the Application for Employment of First Time Jobseekers

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1

Section 1.

Short Title.

- This Act shall be known as the

"First Time Jobseekers Assistance Act".

Section 2

Declaration of Policy.

- It is the policy of the State to promote full employment and equality of gainful work and opportunities for its citizens. As such, the State shall expand accessibility to government services and provide incentives to improve a first time jobseeker’s access to employment.

Section 3 — Waiver of Fees and. Charges.

Waiver of Fees and. Charges.

- Subject to exceptions provided in Section 8 of this Act, all government agencies and instrumentalities, including government-owned and -controlled corporations (GOCCs), local government units (LGUs), and government hospitals shall not collect fees or charges from a first time jobseeker:

Provided,

That such fee or charge is paid in connection with the application for and the granting of licenses, proofs of identification, clearances, certificates or other documents usually required in the course of employment locally or abroad:

Provided, further,

That the benefit provided under this Act shall only be availed of once.

Section 4 — Covered Governmental Transactions.

Covered Governmental Transactions.

- No fees and other charges shall be collected from first time jobseekers when obtaining the following, subject to the requirement in Section 5:

(a) Police clearance certificate;

(b) National Bureau of Investigation clearance;

(c) Barangay clearance;

(d) Medical certificate from a public hospital, provided that fees and charges collected for laboratory tests and other medical procedures required for the grant of a medical certificate shall not be free of charge;

(e) Birth Certificate;

(f) Marriage Certificate;

(g) Transcript of academic records issued by state colleges and universities;

(h) Tax Identification Number (TIN);

(i) Unified Multi-Purpose ID (UMID) card; and

(j) Other documentary requirements issued by the government that may be required by employers from job applicants.

Section 5 — Proof of Eligibility.

- First time jobseekers availing of the benefits provided under this Act shall present a barangay certification stating that the applicant is a first time jobseeker:

Provided,

That any person found guilty of fabrication or falsification shall be liable under the Revised Penal Code.

- The concerned government agencies shall maintain and update a roster of all individuals who have been issued documents under this Act. This roster shall be regularly submitted to the Department of Information and Communications Technology (DICT) which shall compile a database of all beneficiaries of this Act to be made accessible to all relevant agencies.

- The Public Employment Service Office or PESO in different provinces, cities, and municipalities shall assist first time jobseekers in securing required pre-employment documents from relevant government agencies.

- The waiver of fees and charges provided under this Act shall not include those collected in connection with an application to take a professional licensure examination conducted by the Professional Regulation Commission, application for a Philippine passport authentication and red ribbon of documents from the Department of Foreign Affairs, application for a Career Service Examination with the Civil Service Commission (CSC), and application for a driver’s license from the Land Transportation Office.

- This Act shall not be construed as an implied authority for all government agencies to impose or collect charges and fees in relation to the discharge of their functions if no such authority is already granted under their respective charters or other relevant laws.

- The beneficiaries of the Jobstart Program under Republic Act No. 10869 and other laws that give similar exemptions for the documents or transactions enumerated herein shall not be qualified to avail of the benefits of this Act.

Section 11 — Interpretation in Favor of the Applicant.

Interpretation in Favor of the Applicant.

- In all cases, any ambiguity in the interpretation of the provisions of this Act shall be in favor of the applicant.

No government agency or instrumentality shall issue unduly restrictive regulations which will render nugatory the benefits provided under this Act.

Such shall constitute an administrative offense punishable under the Administrative Code and other pertinent laws.

Section 12 — Interagency Monitoring Committee.

Interagency Monitoring Committee.

- An interagency committee is hereby created with the Secretary of the Department of Labor and Employment as chairperson, and as members, the heads of the CSC, the DICT, the Department of Finance, the Department of Education, the Commission on Higher Education, the National Youth Commission, the Technical Education and Skills Development Authority and other departments the participation of which the committee may deem necessary.

The committee shall monitor the compliance of the concerned government agencies and instrumentalities, and may recommend to the proper authorities the filing of an administrative complaint against any person who refuses to comply with the provisions of this Act.

Section 13 — Implementing Rules and Regulations.

- Within sixty (60) days from the effectivity of this Act, the Secretary of Labor and Employment shall, in consultation with the DICT and other concerned agencies, issue the appropriate implementing rules and regulations to effectively implement the provisions of this Act.

- If any provision of this Act is declared unconstitutional or otherwise invalid, the validity of the other provisions shall not be affected thereby.

- All laws, decrees, orders, ordinances, rules and regulations or parts thereof inconsistent with this Act are hereby repealed or modified accordingly.

- This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.

The First Time Jobseekers Assistance Act (Republic Act No. 11261) says the government cannot charge you for the basic documents you need to get hired — NBI clearance, police clearance, barangay clearance, birth certificate, TIN, at iba pa — kung first time kang naghahanap ng trabaho. One time lang ito, pero libre talaga. Kailangan mo lang ng barangay certification na nagpapatunay na ikaw ay isang first time jobseeker.


Real Filipino Scenario: Si Camille na Gusto Nang Magtrabaho

Si Camille, 20 años, ay nagtapos ng vocational course sa Batangas City at gustong mag-apply bilang barber sa isang kilalang barbershop. Binigyan siya ng listahan ng requirements ng employer: NBI clearance, police clearance, barangay clearance, at birth certificate. Halos ₱800–₱1,000 ang kabuuang gastos kung babayaran niya lahat.

Pero dahil first time siyang nagtatrabaho at wala pang employment record, protektado siya ng RA 11261.

Ano ang gagawin ni Camille:

  1. Pumunta sa barangay hall at humingi ng barangay certification na siya ay isang first time jobseeker — libre ito.
  2. Dalhin ang certification sa NBI, Philippine Statistics Authority (PSA), at sa kanilang lokal na police station.
  3. I-present ang certification at huwag mag-bayad ng processing fees para sa mga covered na dokumento.
  4. Makukuha niya ang mga ito nang libre — isang beses lang, kaya i-time niya ito nang maayos.

What the Law Actually Says

Ang First Time Jobseekers Assistance Act ay nag-aatas sa lahat ng government agencies, GOCCs, LGUs, at government hospitals na huwag singilin ang first time jobseekers para sa mga dokumentong kailangan sa pag-apply ng trabaho — lokal man o abroad.

Ayon sa Section 3 ng RA 11261, ang waiver ay sumasaklaw sa mga fees na kaugnay ng "application for and the granting of licenses, proofs of identification, clearances, certificates or other documents usually required in the course of employment locally or abroad."

Ang mga covered na dokumento ayon sa Section 4:

  • (a) Police clearance certificate
  • (b) NBI clearance
  • (c) Barangay clearance
  • (d) Medical certificate mula sa public hospital (pero hindi kasama ang fees para sa lab tests at medical procedures — yung certificate lang)
  • (e) Birth certificate
  • (f) Marriage certificate
  • (g) Transcript of records mula sa state colleges at universities
  • (h) Tax Identification Number (TIN)
  • (i) Unified Multi-Purpose ID (UMID) card
  • (j) Iba pang government documents na required ng employer

Ayon sa Section 5, kailangan mo ng barangay certification para mapatunayan na ikaw ay isang first time jobseeker. Peke ang sinumit? May criminal liability ka under the Revised Penal Code.

Ayon sa Section 8, may mga hindi kasama ang waiver:

  • PRC licensure examination fees
  • DFA passport at authentication/red ribbon fees
  • CSC Career Service Examination fees
  • LTO driver's license fees

Ayon sa Section 7, ang PESO (Public Employment Service Office) sa bawat probinsya, lungsod, at munisipyo ay tumutulong sa mga first time jobseekers na makuha ang kanilang mga pre-employment documents.


What This Means for You / Ano ang Ibig Sabihin Nito

Simple lang ito: kung ito ang unang beses mong maghahanap ng trabaho, hindi ka dapat nagbabayad para sa mga basic na clearance at dokumento.

Ang NBI clearance alone ay aabot ng ₱130–₱155 sa ilalim ng normal na bayad. Dagdag pa ang police clearance, barangay clearance, at PSA documents — madaling mag-iipon ng ₱500 hanggang ₱1,000 bago ka pa man makapag-interview.

Para sa kabataan na bagong graduate o school leaver, malaki ang halaga noon. Ito ang tinutugunan ng batas na ito.

Pero may mahalagang limitasyon: isang beses ka lang makaka-avail nito. Hindi pwedeng gamitin uli kapag naghahanap ka ng pangalawang trabaho. Kaya tiyakin na sabay-sabay mong kuhanin ang lahat ng kailangan mo habang first time jobseeker ka pa.


Real Filipino Scenario: Si Mark na Akala ay Hindi Siya Covered

Si Mark, 24, ay nagtapos ng engineering degree sa isang state university sa Lapu-Lapu City. Nag-apply siya ng trabaho ngayon — first time niya. Akala niya, dahil college graduate siya at may transcript na mula sa SUC, hindi na siya covered ng "first time jobseeker" na batas. May kakilala pa siyang nagsabi na para lang ito sa "mga out-of-school youth."

Mali ito. Walang sinasabing income level, educational attainment, o edad limit ang RA 11261 — basta first time ka pang naghahanap ng trabaho, covered ka.

Ano pa ang napala ni Mark na hindi niya alam:

  • Ang kanyang transcript of records mula sa state university ay libre rin (Section 4g).
  • Ang kanyang TIN at UMID card ay covered din.

Ano ang gagawin ni Mark:

  1. Kumuha ng barangay certification bilang first time jobseeker.
  2. Dalhin ito sa BIR para sa TIN, SSS para sa UMID application, NBI, at sa kanyang state university registrar's office.
  3. Huwag tanggapin ang "bayad muna bago ma-process" — may karapatang ito siya sa ilalim ng batas.
  4. Kung may nagre-require pa rin ng bayad, tumawag sa DOLE hotline o pumunta sa pinakamalapit na PESO office.

What Most Filipinos Get Wrong / Mga Maling Akala

"Para lang ito sa mga walang trabaho sa matagal na panahon." Hindi. Kahit fresh graduate, basta first time kang mag-apply ng trabaho, covered ka.

"Libre pati ang lab tests para sa medical certificate." Hindi. Ayon sa Section 4(d), ang medical certificate mismo ay libre — pero ang bayad para sa lab tests at iba pang medical procedures ay hindi libre. Malaking pagkakaiba ito.

"Pwede ko itong gamitin tuwing mag-re-renew ng clearance." Hindi. Isang beses lang. Kapag nagamit mo na ang benepisyo, tapos na. Planuhin ang timing mo.

"Kasama ang passport at PRC board exam." Hindi. Malinaw na sinabi ng Section 8 — DFA passport, DFA authentication, PRC exam fees, CSC exam fees, at LTO driver's license ay hindi covered.

"Kailangan pang mag-apply sa DOLE para maavail ito." Hindi. Pumunta ka lang sa barangay, kumuha ng certification, at dalhin sa relevant na agency. Hindi kailangan ng espesyal na application sa DOLE.

"Pwede ko itong gamitin kahit kahit gaano na kalaon matapos kong magtrabaho." Kapag nagtrabaho ka na — kahit isang araw — first time jobseeker ka na lang pag-balik mo. Ang batas ay para sa mga wala pang employment record.


Para sa OFWs / For OFWs

Mahalaga ito para sa mga Pilipinong gustong magtrabaho sa abroad for the first time — at para sa mga OFW na may mga kaanak na naghahanap ng trabaho sa Pilipinas.

Kung first time kang mag-aaplang magtrabaho sa ibang bansa:

Ang RA 11261 ay sumasaklaw sa mga dokumento na kailangan sa "application for employment locally or abroad" ayon sa Section 3. Ibig sabihin, kahit OFW-bound ka, covered ka — para sa NBI clearance, barangay clearance, birth certificate, at iba pang basic documents.

Pero may mahalagang eksepsyon para sa OFWs:

Ang mga sumusunod ay hindi libre kahit first time ka:

  • DFA passport — kailangan mo ito bilang OFW, pero Section 8 ay malinaw na hindi ito covered
  • DFA authentication / red ribbon — hindi rin covered
  • POEA/DMW processing fees para sa OEC at deployment — hiwalay na batas ang sumasaklaw dito

Ang praktikal na paraan para sa first-time OFW applicants:

  1. Pumunta sa inyong barangay at kumuha ng barangay certification bilang first time jobseeker.
  2. Dalhin ito sa NBI para sa libreng NBI clearance — kailangan ito ng lahat ng OFW.
  3. Makipag-ugnayan sa pinakamalapit na PESO office sa inyong lungsod o munisipyo — tumutulong sila sa pag-coordinate ng mga pre-employment documents (Section 7).
  4. Para sa DFA passport at authentication, maghanda ng bayad — hindi kasama sa waiver.
  5. Para sa mga katanungan tungkol sa OFW deployment, makipag-ugnayan sa DMW (Department of Migrant Workers) o sa POLO/MWO sa destination country ng inyong employer.

Para sa mga OFW na nagpapadala ng pera para tulungan ang pamilya na nag-aaplang magtrabaho: Ipaalala sa inyong mga kaanak na i-avail ang benepisyo habang maaga — bago pa man matanggap ang trabaho, kumuha na ng barangay certification at lahat ng needed documents.


Real Filipino Scenario: Si Divine na Nagpapadala mula New Zealand

Si Divine, 34, ay isang aged care worker sa Auckland, New Zealand, na nagtatrabaho doon nang limang taon na. May kapatid siyang si Rence, 22, na kakapagtapos lang ng TESDA course sa Batangas City at gustong magtrabaho sa Singapore bilang electrician. Tinatanong ni Divine kung pwede siyang tumulong — at kung libre ba ang mga documents ni Rence.

Ang sagot: Oo, libre — para sa mga covered na dokumento.

Si Rence, bilang first time jobseeker na nag-aaplang magtrabaho abroad, ay protektado ng RA 11261. Ang NBI clearance, barangay clearance, at birth certificate niya ay libre — kailangan lang ng barangay certification.

Ano ang magagawa ni Divine para tumulong:

  1. Sabihin kay Rence na pumunta sa barangay hall at humingi ng first time jobseeker certification — libre ito.
  2. I-remind si Rence na ang passport ay hindi libre — kailangan itong i-budget.
  3. Kung kailangan ni Rence ng tulong sa pag-process, maaaring makipag-ugnayan sa PESO office ng Batangas City.
  4. Para sa Singapore deployment, makipag-ugnayan si Rence sa isang DMW-accredited recruitment agency — mayroon itong listahan sa dmw.gov.ph.
  5. Ang benepisyo ay isang beses lang — tiyakin ni Rence na sabay-sabay niyang kuhanin ang lahat ng kailangan bago siya mag-deploy.

What to Do if Your Rights Are Violated / Ano ang Gagawin

May nagre-require pa ring bayad sa iyo kahit may dala kang barangay certification? Eto ang gagawin mo:

  1. Humingi ng opisyal na resibo o patunay ng bayad — huwag umalis nang walang dokumento kung pinilit kang magbayad.
  2. Alalahanin ang pangalan ng government employee na nangolekta o tumanggi sa iyong benepisyo, pati na ang oras at petsa.
  3. Pumunta sa PESO office ng inyong lungsod o munisipyo — sila ang itinalagang tumulong sa inyo sa ilalim ng Section 7 ng batas.
  4. Makipag-ugnayan sa DOLE — ang DOLE ang nangunguna sa Interagency Monitoring Committee (Section 12). Tumawag sa DOLE hotline: (02) 8527-8000 o bumisita sa pinakamalapit na DOLE regional office.
  5. Mag-file ng reklamo sa CSC kung ang lumabag ay isang government employee — ang pagtanggi sa benepisyo ay maaaring maging administrative offense ayon sa Section 11 ng batas.
  6. I-document ang lahat — screenshot, litrato, o nakasinulat na reklamo — bago mag-file ng opisyal na complaint.
  7. Huwag magbayad kung alam mong protektado ka — ayon sa Section 11, ang anumang hindi malinaw na interpretasyon ng batas ay dapat na pabor sa applicant.

T: Paano ko malalaman kung ako ay "first time jobseeker" sa ilalim ng batas?

A: Kung wala kang kahit isang employment record — kahit part-time, OJT, o contractual — ikaw ay first time jobseeker. Ang pagpapatunay ay ang barangay certification na hihingiin mo sa inyong barangay hall. Libre ito at simple lang makuha.


T: Maaari ko bang gamitin ang benepisyo nang dalawang beses — isa para sa lokal na trabaho, isa para sa abroad?

A: Hindi. Isang beses lang ang benepisyo. Ang "once" na nabanggit sa batas ay nangangahulugan ng isang gamit lang — kahit para sa lokal o abroad. Kaya planuhin ang timing: kumuha ng lahat ng kailangan mong dokumento sa isang pagkakataon.


T: Singilin pa rin ako ng bayad kahit may barangay certification na ako. Ano ang gagawin ko?

A: Una, humingi ng opisyal na resibo. Pangalawa, itala ang pangalan ng government employee at ang agency. Pangatlo, tumawag sa DOLE hotline (02) 8527-8000 o pumunta sa PESO office ng inyong lungsod. Maaari ka ring mag-file ng reklamo sa Civil Service Commission (CSC) laban sa government employee na hindi sinunod ang batas.


T: Kasama ba ang PhilHealth at SSS registration fees sa waiver?

A: Ang SSS UMID card ay kasama sa Section 4(i). Para sa PhilHealth registration mismo, tingnan ang Section 4(j) — "iba pang government documents na required ng employer." Kung nire-require ng employer ang PhilHealth ID o Member Data Record, maaaring makuha nang libre ang registration process. Pero ang mga contribution payments mismo ay hindi covered — ang benepisyo ay para sa processing fees ng documents lang.


T: Mag-expire ba ang barangay certification?

A: Karaniwang may validity ng 3-6 buwan ang mga barangay-issued certifications, depende sa barangay. Humingi ka ng certification na may sapat na validity para gamitin sa lahat ng agencies — NBI, PSA, BIR, SSS. Kung mag-expire bago maubos ang lahat ng dokumento, pwedeng humingi ng bago — pero ang benepisyo ay isang beses pa rin.
