Title IV — Property Relations Between Husband and Wife
Article 88
ELI5— what this means for you
Under Absolute Community of Property (ACP) — the default regime — almost everything you and your spouse own before marriage AND everything you acquire during marriage becomes co-owned property. You cannot sell, mortgage, or dispose of ACP property without the other spouse's consent.
Key point
ACP = pool of shared ownership covering nearly all property. This is the default if you have no prenup.
Official text — EO 209
The absolute community of property between spouses shall commence at the precise moment that the marriage is celebrated. Any stipulation, express or implied, for the commencement of the community regime at any other time shall be void. (145a)
