Title IV — Property Relations Between Husband and Wife

Article 87

EO 209 · Family Code of the Philippines

ELI5— what this means for you

Spouses cannot give each other gifts during the marriage that are 'moderate' gifts on the occasion of family rejoicing — small, reasonable gifts for birthdays, anniversaries, etc., are fine. But major transfers of property between spouses during marriage are generally void, as the law protects against one spouse impoverishing themselves for the other.

Official text — EO 209

Every donation or grant of gratuitous advantage, direct or indirect, between the spouses during the marriage shall be void, except moderate gifts which the spouses may give each other on the occasion of any family rejoicing. The prohibition shall also apply to persons living together as husband and wife without a valid marriage. (133a)
