Title VIII — Support

Article 204

EO 209 · Family Code of the Philippines

ELI5— what this means for you

The obligor (person required to pay support) can satisfy the obligation either by paying an allowance or by receiving and maintaining the recipient in their own home. The obligee (recipient) cannot demand cash if the obligor genuinely chooses the in-home maintenance option, unless there are valid grounds for objection (hostility, incompatibility, etc.).

Official text — EO 209

The person obliged to give support shall have the option to fulfill the obligation either by paying the allowance fixed, or by receiving and maintaining in the family dwelling the person who has a right to receive support. The latter alternative cannot be availed of in case there is a moral or legal obstacle thereto. (299a)
