Article 349Bigamy
ELI5— what this means for you
Bigamy: contracting a second marriage while the first marriage is still valid. Penalty: prision mayor (6–12 years). A judicial declaration of nullity of the first marriage must be obtained BEFORE remarrying — not after.
Key point
You cannot remarry without a court decision declaring your first marriage null or annulled. Doing so is bigamy.
Official text — Act No. 3815

-The penalty of prision mayor shall be imposed upon any person who shall contract a second or subsequent marriage before the former marriage has been legally dissolved, or before the absent spouse has been declared presumptively dead by means of a judgment rendered in the proper proceedings.
