If the spouse who remarried under a presumptive death declaration knew that the absent spouse was still alive, they acted in bad faith. The bad-faith spouse forfeits their share of the net profits from the second marriage's community property in favor of the children of the second marriage, or the innocent spouse.

If both spouses of the subsequent marriage acted in bad faith, said marriage shall be void ab initio and all donations by reason of marriage and testamentary dispositions made by one in favor of the other are revoked by operation of law. (n)
