Title XII — Final Provisions
Article 255
ELI5— what this means for you
Marriages celebrated before the effectivity of the Family Code (August 3, 1988) are governed by the old Civil Code rules on marriage validity — they are not retroactively governed by the Family Code. However, the Family Code's provisions on void marriages and the requirement of judicial declaration of nullity (Art. 40) do apply even to pre-Family Code void marriages if you want to remarry.
