The court shall decide the petition for presumptive death summarily, based on the evidence presented. There is no need for a full trial with witnesses examined at length — affidavits and documents are sufficient for the court to rule.

In case of non-appearance of the spouse whose consent is sought, the court shall inquire into the reasons for his failure to appear, and shall require such appearance, if possible. (n)
