The child is presumed legitimate even if the mother declares the child is illegitimate or states she had a relationship with another man — the mother's admission alone cannot overcome the presumption of legitimacy. Only a court can declare a child illegitimate.

The child shall be considered legitimate although the mother may have declared against its legitimacy or may have been sentenced as an adulteress. (256a)
