Article 782

RA 386 · Civil Code of the Philippines

ELI5— what this means for you

An heir inherits the entire estate (or an aliquot portion). A legatee or devisee receives specific personal or real property named in a will. The distinction matters because heirs are liable for debts; legatees generally are not.

Official text — RA 386

An heir is a person called to the succession either by the provision of a will or by operation of law.

Devisees and legatees are persons to whom gifts of real and personal property are respectively given by virtue of a will. (n)
