The mother who contracts a subsequent marriage loses the parental authority over her children, unless the deceased husband, father of the latter, has expressly provided in his will that his widow might marry again, and has ordered that in such case she should keep and exercise parental authority over their children.

The court may also appoint a guardian of the child's property in case the father should contract a subsequent marriage. (168a)
