How are crimes classified in the Philippines?

Drug-related offenses dominate at 34.2% — a legacy of the intensified anti-drug campaign since 2016. Violence and theft collectively account for another 35% of all reported crimes.

Drug offenses are prosecuted under RA 9165 (Comprehensive Dangerous Drugs Act). Penalties range from 12 years to life imprisonment depending on quantity and offense type. First-time offenders with small amounts may qualify for rehabilitation under Section 11.

How has crime changed over time?

Total crime incidents dropped sharply in 2020 during COVID-19 lockdowns, then rebounded to a decade high in 2023. The 2023 figure of 1.57M is the highest recorded since 2015.

Violence Against Women and Children (VAWC)

Over 100,000 VAWC cases are filed annually. NCR accounts for the most reported cases, though urban areas generally have better reporting infrastructure.

Under RA 9262, VAWC victims can get a Barangay Protection Order (BPO) within 24 hours — no lawyer needed. The barangay captain is required by law to issue it. Criminal penalties range from 1 month to 12 years imprisonment.

Under RA 9165, the minimum quantity for mandatory imprisonment: shabu/methamphetamine (5g), marijuana (300g). Below these thresholds, first-time offenders may be referred to rehabilitation rather than prosecution under the Plea Bargaining Framework.

Under RA 8493 (Speedy Trial Act), criminal cases must be resolved within 180 days from arraignment. Violations may result in dismissal. If your case has been pending beyond this period, your lawyer can raise this as a defense.
